1. General Conditions

 

1.1 Legal Identification. This platform is operated by Kamaway®, a registered trade name. In compliance with applicable information society, consumer protection and business identification regulations, the full legal identity of the operator (including Tax ID and registered address) is provided to the Client during the contracting process and included in official invoices.

1.2 Scope of Service. Kamaway® provides educational mobility coordination services for students, educational institutions and organisations participating in international mobility projects.

Kamaway® acts as an independent intermediary and coordinator between Clients and local Partners, including internship host companies, educational institutions, accommodation providers and other mobility-related service providers.

Kamaway® facilitates communication, coordination and administrative processes required for the organisation of educational mobility services. Kamaway® does not own, operate or directly control the services provided by independent Partners.

Kamaway® does not act as a tour operator and does not provide package travel services as defined under Directive (EU) 2015/2302.

1.3 Nature of Partners. Kamaway® does not own, operate or control the services provided by independent Partners.

Each Partner remains responsible for the direct provision of its own services, including compliance with its own operational rules, availability, conditions and requirements.

Where applicable, the contract for specific third-party services may be established directly between the Client and the relevant Partner.

1.4 Acceptance of Terms. By submitting a request, placing an order or completing a booking through Kamaway®, the Client acknowledges and accepts these Terms and Conditions.

The Client also acknowledges that Kamaway®’s role is limited to educational mobility coordination, organisation and facilitation services.

1.5 Agreement Precedence. Where the Client contracts a specific Kamaway® service agreement, including internship placement or other educational mobility services, the specific agreement accepted during the contracting process shall prevail over these General Terms in matters relating specifically to that service.

In case of conflict regarding service-specific fees, cancellation conditions, exclusions or responsibilities, the specific agreement shall govern.


 

2. Services and Bookings

 

2.1 Kamaway® provides educational mobility coordination services where Clients can request and arrange services including internship placements, job shadowing programmes, study trips, accommodation assistance related to educational stays and other mobility-related educational services.

2.2 Each service request or booking is confirmed only once Kamaway® or the relevant Partner has verified availability and issued written confirmation (usually via email).

2.3 Kamaway® will endeavour to provide Clients with relevant service conditions and applicable Partner terms, including cancellation and refund policies where available, prior to confirmation.

Clients are responsible for reviewing the information provided and requesting any necessary clarification before confirming the service.

Kamaway® reserves the right to decline or cancel any service request or booking in case of incorrect information, unavailability, suspected fraud or payment issues.


 

3. Payments and Invoicing

 

3.1 Payments can be made via bank transfer, credit/debit card, or other methods displayed on the website or agreed with Kamaway®.

3.2 Tax Treatment: Prices and applicable taxes are determined according to the nature of the service provided, the Client’s tax status and applicable European and national tax regulations.

VAT treatment may vary depending on whether the Client is an individual, a business entity, an educational institution or another type of organisation.

Where applicable, EU VAT rules regarding business-to-business services and reverse charge mechanisms may apply.

Clients are responsible for providing accurate billing information, including valid VAT identification details where required.

3.3 Certain services provided through independent Partners may include additional charges, local taxes or fees established by those Partners.

Where applicable, these amounts will be communicated according to the conditions of the relevant service provider.

Kamaway® is not responsible for the calculation, application or refund of charges established directly by independent Partners.

3.4 Kamaway® will issue an invoice or payment confirmation once the service has been confirmed and payment has been received.

Invoices will be issued in accordance with the billing information provided by the Client.


 

4. Cancellation and Refund Policy

 

4.1 General rule: Kamaway’s own refund policy is limited. Except as expressly stated below, refunds are processed only when:

a) the payment was made in error (duplicate or manifestly incorrect charge) — in which case Kamaway® will refund the amount after verification; or

b) Kamaway® or the relevant Partner is unable to provide the confirmed service — in which case Kamaway® will process a refund for amounts not transferred to the Partner or will endeavour to offer an alternative solution.

4.2 Partner policies prevail: Many Partners have their own cancellation, modification and refund conditions.

Where a Partner’s policy provides for refunds, Kamaway® will assist the Client with the relevant process. However, Kamaway® cannot guarantee refunds that depend on the decision or policy of an independent Partner.

4.3 Erasmus & Internship bookings: For internship coordination services and other educational mobility programmes, specific deposits, cancellation conditions and non-refundable fees are governed exclusively by the specific service agreement accepted during the contracting process.

Such specific agreements may supersede the general rules contained in this Section 4.

4.4 Accommodation bookings: Where accommodation assistance is provided through independent Partners, cancellation conditions and possible refunds are determined by the relevant accommodation provider.

If the Partner does not allow refunds, Kamaway® cannot unilaterally grant a refund unless Kamaway® itself is unable to deliver the confirmed service.

4.5 Educational services: Cancellation conditions for educational services provided by Partners, including language courses or training activities, are subject to the terms and conditions established by each educational provider.

4.6 To request a cancellation or refund, the Client must contact Kamaway® by email at info@kamaway.net and provide all relevant service information and supporting documentation.

4.7 Right of Withdrawal: Where applicable, the right of withdrawal may not apply to services related to specific dates or periods of performance, including educational stays, accommodation arrangements or other time-specific services, in accordance with applicable European and national consumer protection legislation.


 

5. Responsibilities and Liability

 

5.1 Kamaway® acts as an educational mobility coordinator and independent intermediary. Kamaway® cannot be held responsible for the direct execution, quality, availability, safety or compliance of services provided by independent Partners.

5.2 The Client is responsible for providing accurate and complete information, including names, dates, identification documents, VAT information where applicable, contact details and any other information required for the correct organisation of the service. Errors, delays or additional costs resulting from incorrect or incomplete information provided by the Client shall be the responsibility of the Client.

5.3 Kamaway® will not be liable for:

a) delays, cancellations or changes caused by Partners, force majeure, weather conditions, transport disruptions, public authority decisions or other events beyond Kamaway’s reasonable control;

b) loss or damage to personal property;

c) medical, visa, immigration or documentation issues arising from the Client’s failure to obtain or provide the required documents;

d) costs associated with third-party charges, including bank fees, currency exchange costs or Partner-required deposits, except where such costs result directly from Kamaway®’s negligence.

5.4 Nothing in these Terms shall exclude or limit Kamaway’s liability for gross negligence or wilful misconduct.

5.5 Independent Services: Kamaway® does not offer package travel services as defined by Directive (EU) 2015/2302. Each service provided by an independent Partner remains subject to its own conditions and responsibilities. Kamaway® is not responsible for the combined execution of services provided by different independent Partners.


 

6. Accommodation

 

6.1 Accommodation options may be arranged through independent third-party Partners as part of educational mobility services. Room type, check-in/check-out conditions, cleaning requirements, deposits and house rules are established by the relevant Partner and apply to each accommodation arrangement.

6.2 The Client must comply with the rules and conditions established by the accommodation Partner. Any damage, misuse or breach of accommodation rules may result in additional charges imposed directly by the Partner.

6.3 If an accommodation Partner cancels a confirmed accommodation arrangement and Kamaway® cannot provide an equivalent alternative, Kamaway® will refund amounts not yet transferred to the Partner or will assist the Client in finding available alternative accommodation, subject to availability and any applicable price differences.


 

7. English Courses and Educational Services

 

7.1 Partner Responsibility: Language courses and other educational programmes may be provided by independent educational Partners. Each Partner remains responsible for its own teaching methods, placement procedures, attendance requirements, internal policies and certification processes.

7.2 Course Changes: Kamaway® is not responsible for changes in schedules, teachers, classroom locations or other operational aspects established by the educational Partner.

7.3 Attendance and Conduct: The Client is responsible for complying with the attendance requirements and behavioural rules established by the educational Partner. Failure to meet these requirements or removal from a programme due to misconduct does not entitle the Client to a refund unless otherwise established by the Partner’s own policy.


 

8. Data Protection

 

8.1 Regulation Compliance: Kamaway® processes personal data in strict compliance with the EU General Data Protection Regulation (GDPR) and applicable Spanish data protection legislation, including the Spanish Organic Law on Data Protection and Digital Rights Guarantee (LOPDGDD).

8.2 Purpose of Processing: Personal data (including names, identification documents, contact details and other information required for mobility organisation) is collected exclusively for:

Managing educational mobility services and facilitating communication between the Client and relevant Partners.

Invoicing and tax compliance.

Providing support and handling service-related requests, cancellations or refund procedures.

8.3 Data Sharing: By using Kamaway® services, the Client acknowledges and consents that Kamaway® may need to share relevant personal data with independent Partners (including educational institutions, internship host companies, accommodation providers or other mobility-related service providers) located in Malta or other destinations, where necessary for the correct organisation and delivery of the service.

8.4 Rights of the User: Users may exercise their rights of access, rectification, erasure, objection and other applicable data protection rights by sending a written request to info@kamaway.net. 9. Changes to Terms

 

9.1 Kamaway® may modify these Terms and Conditions at any time. Changes will be published on the website and will apply to services contracted after the publication date.


 

10. Governing Law and Jurisdiction

 

10.1 These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Spain.

10.2 Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the jurisdiction of the competent courts of Spain.
